Divorcing in Turkey

Matters of Turkish family law can be complicated for persons who do not speak the language. This is especially the case for divorcing in Turkey before a court. Court decisions obtained from a foreign country are not automatically valid in Turkey and thus cannot be registered directly with the relevant Turkish public institutions. Foreign Nationals in Turkey

Matters of work and residence permits, obtaining Turkish citizenship but also applications for asylum seekers are among our working fields.

Foreign nationals who reside in Turkey illegally or whose residence permit has expired, are at risk of getting deported. While awaiting a final administrative decision, the foreign nationals are generally placed in detention and deportation centers throughout the country. During this time foreign nationals have the right to consult with a lawyer, who can evaluate and assess their case file.

Matters of inheritance in Turkey

Although Turkish inheritance law is similar to some European legal systems in several aspects, there are also important differences. The presence of a will may not fully include or exclude all heirs and the inheritance portions may be different with regard to family members.

The first step is to obtain a certificate of inheritance in which all legal heirs are stated. In case (one of) the heirs do not have the Turkish nationality such certificate can only be obtained through court upon proof of kinship. After obtaining the certificate, the inheritance can be legally registered in name of the heirs. Depending on the type of good, registration needs to be done through public institutions. Primarily, the inheritance will be registered in name of all legal heirs in accordance with their portion. Thereinafter, the heirs may freely transfer their portions.
